Welcome to https://mercantile.wordpress.org (the “Store”), the official WordPress.org swag store. The Store is operated by or on behalf of the WordPress Foundation, a 501(c)(3) nonprofit organization. All proceeds support the mission of the WordPress Foundation.

1. Use of the Store

If you create an account, you are solely responsible and liable for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate your account for any reason, including violations of these Terms.You agree to use the Store only for lawful purposes and in accordance with these Terms. You may not use this Store:

• To violate any applicable law or regulation.
  
• To infringe on the rights of others.
  
• To attempt to gain unauthorized access to or interfere with the proper functioning of the Store or its operations.

2. Orders, Shipping, and Returns

Depending on your shipping address, local taxes or customs duties may apply. You are responsible for any such charges imposed by your jurisdiction.

Shipping times and fees may vary based on your shipping address and product availability. Once an item is shipped, tracking information (if available) will be provided. We are not responsible for delays caused by the carrier or customs processing.

All sales are final unless the item is defective or damaged upon arrival, so please review sizing and product details carefully before placing an order. If there’s an issue with your order, please contact mercantile@wordpress.org within 14 days of receiving your item.

3. Intellectual Property

All WordPress logos, designs, and merchandise are trademarks of the WordPress Foundation. Use of these marks is governed by our Trademark Policy.

4. Disclaimer of Warranties

All products are provided “as is” without warranties of any kind. We make no guarantees regarding the quality, fit, or performance of any product sold through the Store.

5. Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Terms and any access to or use of the Store will be governed by the laws of the state of California, U.S.A., excluding its conflict of law provisions and the application of the United Nations Convention of Contracts for the International Sale of Goods, and the proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in San Francisco County, California, U.S.A. Nothing in the Terms affects your rights as a consumer to rely on mandatory provisions in your country of residence.

6. Limitation of Liability

In no event will the WordPress Foundation, or its suppliers, partners, or licensors, be liable with respect to any subject matter of the Terms under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed $50 or the fees paid by you to the WordPress Foundation under these Terms during the twelve (12) month period prior to the cause of action, whichever is greater. The WordPress Foundation shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

7. Modifications

We may update these Terms from time to time. Continued use of the Store after changes constitutes acceptance of the new Terms.
